Two days after predicting that the family of Diana Paz, the pedestrian killed on Eisenhower, would not bring a lawsuit for her death, the family brought a lawsuit. In all fairness, the lawsuit is a discovery lawsuit seeking facts relating to the 25-year-old woman’s death and not a wrongful death lawsuit, but clearly the tracks are being laid for a possible action for damages.
Diana Paz was pulled over earlier this week for a DUI after driving the wrong way up I-290. She failed several field sobriety tests and was brought to a Village of Westchester police station. Shortly after being taken to jail, Paz was bonded out and released. Police stated that the woman seemed “alert” and dropped her off at a gas station in the early morning hours.
Within three hours of her DUI stop, and within a half-hour of being dropped off at the gas station, Paz was struck by a pickup truck while walking down Eisenhower Expressway. She later died.
Now Paz's family wants to know why the police dropped her off at a gas station at six in the morning -- alone and only hours after a DUI -- reports the Chicago Sun-Times. So far, her family has only brought a discovery lawsuit. This means that Paz's family wants to know if the woman was drunk at the time of her release and whether she was in the proper state to be released.
Beyond mere curiosity, one would have to believe that if Diana Paz's family finds that the young pedestrian killed on Eisenhower was still drunk or otherwise not in the right state of mind when released from police custody, they may bring further legal action against the village.
