Sandra Uher Shows Up Drunk to Court Hearing for Sixth DUI

Elgin resident Sandra Uher had her bail revoked after showing up to court drunk for her sixth DUI charge. The Associated Press reports that the 54-year old Uher was free on $100,000 bail when she was taken into custody.

According to the AP, Sandra Uher was arrested for her sixth DUI in March after failing a field sobriety test with a blood alcohol content of 0.30 (almost four times the legal limit). To make matters worse, Uher was driving with a revoked license. Uher now faces up to 30 years in jail for her sixth DUI arrest.

Sandra Uher hitting a sixth DUI charge is important because in Illinois a court can now charge her with its most severe Felony charge, a Class X Felony, at the sixth DUI. With a Class X felony, Uher faces a potential $25,000 fine, community service, as well as up to 30 years jail time. In addition, Uher’s driving privileges can be revoked for life.

Illinois has very harsh DUI laws and anyone convicted could go to jail even for the first DUI offense. Generally, the first two DUI convictions are considered misdemeanors with the possibility of jail for up to a year and a license suspension of up to five years.

After the third DUI offense, defendants can be charged with an Aggravated DUI and face felony charges. If convicted of a third or fourth DUI charge, defendants face a Class 2 felony charge and can go to jail for up to seven years. For a fifth DUI charge, it is a Class 1 felony and can result in a sentence of up to 15 years.

It’s unclear whether Sandra Uher has already served prison time for her five previous DUIs, but she now faces Illinois’ most severe felony charge for her sixth DUI offense. It also doesn’t help that Uher showed up to court drunk.
